End User License Agreement (EULA) for BestPic.AI
Please read this End User License Agreement (“Agreement”) carefully before using the BestPic.AI application. By downloading, accessing, or using BestPic.AI, you agree to be bound by the terms and conditions of this Agreement.
1. License Grant
Optiwisdom Inc. (“We,” “Our,” “Us”), the provider of BestPic.AI (“App”), grants you a limited, non-exclusive, non-transferable, revocable license to use BestPic.AI strictly in accordance with this Agreement. This license is solely for personal, non-commercial use on any device you own or control, as permitted by the App Store Terms and Conditions.
2. User Conduct
You agree to use BestPic.AI solely for lawful purposes and in a way that does not infringe the rights of others or restrict or inhibit anyone else’s use of the App. In using the App, you agree to abide by all local, state, and federal laws, as well as the App Store’s Terms of Service.
3. In-App Subscriptions
BestPic.AI offers a monthly subscription at $2.99 and an annual subscription at $19.99, both with a 3-day free trial. Subscription fees are billed through the App Store, and any changes to these fees are subject to the App Store’s terms. Subscription payments are automatically renewed until canceled. Cancellations take effect at the end of the current subscription period. We do not issue refunds for unused portions of any subscription.
4. Privacy Policy
Our Privacy Policy, available at [Link to Privacy Policy], governs the collection, use, and storage of personal information collected from users. By using BestPic.AI, you agree to the practices described in our Privacy Policy.
5. Ownership and Intellectual Property
The App, including all content, features, and functionality, is and remains the exclusive property of Optiwisdom Inc. All rights, titles, and interest in and to the App, including any copyright, trademark, and other intellectual property rights, belong to Optiwisdom Inc.
6. User Content and Data
You grant Optiwisdom Inc. the right to use, process, and analyze your uploaded images for the purpose of providing image-scoring services. BestPic.AI does not claim ownership of your images. However, by using the App, you allow us to use aggregated, anonymized data for analytical and improvement purposes.
7. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Optiwisdom Inc. be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App.
8. Disclaimer of Warranties
The App is provided on an “as-is” and “as-available” basis. We make no representations or warranties of any kind, express or implied, regarding the App, its functionality, or availability.
9. Changes to the Agreement
We reserve the right to modify this Agreement at any time. Any changes will be posted on our website or within the App. By continuing to use the App after any changes, you agree to be bound by the modified Agreement.
10. Termination
We may terminate or suspend your access to BestPic.AI at our sole discretion, without prior notice or liability, for any reason, including but not limited to breach of this Agreement. Upon termination, your license to use the App will cease immediately.
